A swift attack is the best form of defense

The assertion that a deliberate, swift attack has the best chance of success also applies to collection procedures. That is why our collection procedure consists of an efficient and direct "three-step plan".

Step 1: A reminder is sent within 24 hours of instruction.

Step 2: A second letter along with a summons is sent two weeks later.

Step 3: Failure to settle the debt within 4 weeks results in the execution of the summons.

  • The first two letters are formulated in consultation with you.
  • The letters are sent by Stuy Advocaten but include details of your bank and/or giro account. The debtor therefore pays you directly, which means that you can keep track of developments and have immediate access to your money.

  • What do I have to do?
  • Send us a copy of the outstanding invoice by fax or post, including information about the debtor.

  • What does Stuy Advocaten do?
  • We send the first reminder within 24 hours of receipt of the invoice. If we do not hear anything within two weeks, a second letter along with a draft summons is automatically sent in order to increase pressure on the debtor. In our experience more than 80% of the debtors settle after the first or second letter.

  • If the debtor has still not paid after this period has expired, we do not send any more letters, but proceed with the summons.
  • After judgement has been pronounced, we act to recover the debt, along with interest and any other costs incurred.
  • Who pays for the legal proceedings?
  • The cost is charged to the debtor. In the verdict the judge will order the debtor to settle the invoice, plus interest and any other costs incurred.

  • Security
  • During the procedure, attachment may be levied on goods, property, income or bank accounts. This serves to ensure that the debt(s) plus costs can actually be recovered.
